California law provides several legal remedies that may help clean your record—if you qualify. We’ve successfully guided countless clients through this process, helping them understand which post-conviction relief options are available and how to pursue them effectively.
Record Clearing Options in California
Your eligibility for any type of criminal record relief depends on:
- The nature of your conviction (infraction, misdemeanor, felony)
- Whether you received probation, jail, or prison time
- Whether you’ve completed all court-ordered obligations
- Your age at the time of conviction
- Whether you're facing current charges or are on probation/parole
- California offers the following post-conviction relief options:
- Misdemeanor and Felony Expungement
- Certificate of Rehabilitation
- Felony Reduction under PC §17(b)
- Early Termination of Probation
- Motions to Vacate Convictions (Immigration-related relief)
What is Expungement?
Expungement is a legal process that reopens your case, withdraws your guilty plea or verdict, and dismisses the conviction. This is often available to those who:
- Completed probation successfully
- Were convicted of a misdemeanor or certain felonies
- May have had minor probation violations (reviewed on a case-by-case basis)
If your conviction involved state prison, expungement is typically not available, but other options like a Certificate of Rehabilitation or Motion to Vacate may apply.
Felony Expungement & Felony Reduction
If you were convicted of a felony but served probation (not prison time), you may be eligible for expungement. Additionally, some felonies may qualify for reduction to a misdemeanor under Penal Code §17(b). This reduction can open doors to jobs, licenses, and more.
Immigration Concerns? Consider a Motion to Vacate
If you're a non-citizen and your previous attorney failed to inform you of the immigration consequences of a guilty plea—or if you didn’t fully understand those consequences—you may qualify to file a Motion to Vacate your conviction. If successful, your plea is nullified, which could remove the immigration issues tied to the conviction.
Tip: While California law does not require you to disclose your immigration status to your criminal attorney, it's always wise to be transparent. It can only help your defense.
Early Probation Termination
If you've completed at least half of your probation term and complied with all court requirements, you may petition for early termination. Once granted, you may be eligible for immediate expungement.
How to Know If You Qualify
Under California Penal Code §1203.4, you may be eligible for expungement if:
- You successfully completed probation or waited the required one-year period for infractions/misdemeanors without probation
- You’ve paid all fines, fees, and restitution
- You’re not facing any new criminal charges or serving another sentence
- Your case did not involve state prison time
